Your use of the XVIDA Web Site (the “Site”) constitutes your agreement to follow and be legally bound by these terms and conditions (the “Agreement”). The Site is owned and operated by XVIDA Inc.. (“XVIDA”). As used herein, the terms “we,” “us” and “our” refer to XVIDA. IF YOU DO NOT AGREE WITH THIS AGREEMENT, OR ARE DISSATISFIED WITH THE SITE FOR ANY REASON, YOUR SOLE AND EXCLUSIVE REMEDY IS TO NOT USE THE SITE.
Trademark and Brand Policy
The trademarks, service marks and logos (the “Trademarks”) used and displayed on this Site are registered and unregistered Trademarks of XVIDA. Nothing on this Site should be construed as granting, by implication, es toppel or otherwise, any license or right to use any Trademark displayed on the Site, without the prior written permission of the Trademark owner. Other product and company names mentioned in this Site may be the Trademarks of their respective owners. For example, iPad is a Trademark of Apple Inc. or its affiliates.
XVIDA’s trademarks and trade dress are protected in the US and internationally, and may not be used without our written permission. XVIDA’s trademarks include, but are not limited to, XVIDA logo, and other graphics, phrases or images that identify the source or origin of XVIDA’s product and services. Do not alter or modify the marks or use them in a confusing way that suggests that XVIDA sponsors or endorses you or your products or services, or confuses the XVIDA brand with another brand. Please do not apply for a trademark containing XVIDA or one of our other marks, and do not use XVIDA in your website name or register a domain name that contains XVIDA or any of our other marks, or misspellings or other variations of our marks. Your website or social media fan site must not copy the distinctive XVIDA look and feel, as we do not want anyone to be confused about whether it’s your site or our site.
The XVIDA patents, designs and intellectual property (the “IP”) indicated and displayed on this Site are the sole property of XVIDA. We reserve all rights to the IP.
All orders placed on the Site are subject to product availability and will be shipped according to XVIDA’s shipping policies. Delivery dates provided in connection with any order are estimates only and do not represent fixed or guaranteed delivery dates. In the rare event that you do not receive your order after we ship it, you must notify us of this within 60 days from receipt of the shipping confirmation e-mail, otherwise, your order will be deemed delivered and you will be liable for payment on your order.
We will not be liable for delays in delivery or for failure to perform our obligations due to causes beyond our reasonable control. Our time for delivery or performance will be extended by the period of such delay or we may, at our option, cancel any order or remaining part thereof, without liability by giving notice to you.
RETURNS & EXCHANGE
If you are not completely satisfied with your purchase you may return the item to us in its original condition within 14 days of receipt.
Requirements for Returns:
- Must include a valid original purchase order number from xvida.com. Purchases made outside of xvida.com must contact respective seller for returns.
- Returns made without receipt may be refused.
- Returned products must be unused, in their original packaging without any missing contents.
- Return shipping is at buyer's cost unless stated otherwise by our support team.
- Customer will be given a Product Refund—shipping & handling fees will NOT be refunded.
- Non-returnable items include items purchased through retailers, and damaged products through customer mishandling.
*We suggest adding a tracking number/delivery confirmation on returned packages to ensure your return is received. XVIDA Inc. is not liable for lost or stolen return packages during transit/delivery. Depending on where you live, the time it may take for your exchanged product to reach you, may vary.
All Sale and Promotional Items are not eligible for Returns, Exchanges, or Warranties.
All exchanges are subject to availability.
How to claim a refund?
Contact customer service at firstname.lastname@example.org and provide valid Proof of purchase and provide brief reason
We will provide you with the ship to address.
Send the products to the address provided
Processed refunds are completed within 10 business days of receipt of returned products.. Refunds will be issued based on your original form of payment (PayPal, credit card, debit card, etc.)
Items already shipped are not reversible, and must then be returned for a refund (please see the “Refunds” section above). Please note that the cost of this return has to be paid by the customer.

One-Year Limited Warranty
We offer a one-year limited manufacturer warranty on a majority of XVIDA products. Purchases made outside of xvida.com must contact respective sellers regarding warranty claims.
Certain XVIDA products may have different warranties, which will be explicitly stated here. This warranty is only valid for items that are considered defective. Defects are defined as imperfections or flaws that are produced by a manufacturing error. Accidental drops, installation failures, normal wear and tear, etc. caused by the owner are not covered under this warranty. This warranty is extended to the original end-user purchaser, beginning at the time of retail purchase.
General Defect Warranty
All products listed below come with a 100-day general warranty*

*All terms and conditions for any and all warranties are subject to change under the sole discretion of XVIDA Inc.
Only products that are purchased directly from XVIDA are eligible for this warranty as other sellers/channels may offer different or altered warranties. The warranty does not cover the following:
- Normal wear and tear from daily use of product
- Product was used for unintended purposes
- Accidental drops, installation failures caused by the owner
- Misuse, mishandling, accident, or other abnormal use of product
- Damage caused by improper or unauthorized repair or maintenance
- Product is not genuine or not manufactured by XVIDA
- 3rd party purchases, made outside xvida.com are not covered under XVIDA warranties
How to submit a warranty:
To get your warranty product covered contact customer support at firstname.lastname@example.org with order number and detailed description of the issue. Once you have received reply from the Warranty Support Team, return the package for physical inspection to the address provided along with the following information: Full name used during purchase, Order Number, Proof of Purchase.
Please note: ALL shipping costs for sending back your products will be in the responsibility of the owner. Any customs fees, including, but not limited to, taxes, duties and any other courier related fees, are in the responsibility of the owner. We advise using a traceable shipping method to ensure safe delivery to XVIDA Inc. XVIDA Inc. is not liable for lost, stolen, or damaged shipments for returning packages.
Once the product is received by XVIDA, the product will be inspected (within 7-10 business days of receipt on average) to determine if it is covered under the limited warranty. If the product is determined to be covered under the Limited Warranty, XVIDA, under its judgment and discretion, will repair, replace, or recondition the product. XVIDA Inc. will pay for the shipment of any replacement parts or products under the limited warranty to remedy the defective product.
Except for the express warranties provided herein, XVIDA Inc. (“XVIDA”) makes no express or implied warranties of any kind whatsoever with respect to the product in terms of merchantability, fitness, particular purpose, design, condition, quality, or performance of the product. In addition, XVIDA will not be liable for any damages of any kind resulting from the purchase or use of products or incidental damages or consequential loss of profits or benefits.
XVIDA reserves the right to waive responsibility for warranty coverage for situations including, but not limited to, other implied warranties from authorized or unauthorized sellers, warranties expressed in written or verbal form for non-genuine or counterfeit XVIDA product distributors or vendors, any intentional action to contort or take advantage of the warranty for financial or personal gain.
Defects caused by any other accident, including failure of installation, carelessness by the user, or defects caused by owner's usage, cannot be applied for the above mentioned warranties. For products that come as a package/kit, only the defected item from the package/kit will be remedied. This remedy may be repeated within 90 days or the remainder of the warranty. The original product is needed for any future warranty requests regarding the order.
XVIDA reserves the right to replace, repair, rebuild, and recondition products at XVIDA’s sole option. If the product under warranty becomes inactive or no longer in production, XVIDA reserves the right to replace the inactive product with a similar or better product in accordance to XVIDA judgment and discretion.
By purchasing at xvida.com, you acknowledge that you have had an opportunity to review XVIDA’s warranty terms, have done so to the degree you need to be familiar with them, and you accept their terms and conditions, including the limitations, exclusions, and disclaimers in them. Certain jurisdictions do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the disclaimers, exclusions or limitations may not apply to you, and you might have additional rights.
Limitation of Liability
IN NO EVENT SHALL XVIDA, ITS OFFICERS, DIRECTORS, DISTRIBUTORS, SUPPLIERS, OR AGENTS (COLLECTIVELY "COMPANY") BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF ANY XVIDA PRODUCT, INCLUDING, WITHOUT LIMITATION, DEVICE DAMAGE, DATA LOSS, OR LOSS OF USE OF ANY PRODUCT, EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANY DAMAGES THAT YOU MIGHT INCUR FOR ANY REASON WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ALL DAMAGES REFERENCED HEREIN AND ALL DIRECT OR GENERAL DAMAGES IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE), THE ENTIRE LIABILITY OF COMPANY SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE PRODUCT. SOME STATES AND/OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.
